Our products and services include, but are not limited to, the GemLightbox Pro, GemCam Pro, Elite Kit Pro, GemHub App, turntables, cloud storage, and our image retouching services (collectively, the "Services").
This Policy shall apply to GemIQ, Picup Media, GemHub and any other related company, or brand, services, products, and platforms managed by us.
This policy is an integral part of our Terms of Service. By using our Services, you agree to the terms outlined in this IP Policy.

3. License Granted to GemIQ

Limited License for Service Operation: By using the Services, you grant GemIQ a limited, non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and display your User Content. This license is granted for the sole purpose of operating, providing, securing, and improving the Services. Examples of this include:

Hosting and backing up your files on GemHub.

Processing your images for services you request, such as background removal or retouching.

Use for Promotional Activities: We will never use your User Content for our marketing or promotional materials without your explicit prior written consent. You may be invited to feature your work, but participation is entirely optional.

Use for AI Model Training: To improve the features and functionality of our AI-powered software or jewelry intelligence pursuant to our Terms of Service, we may use User Content to train our algorithms. When doing so, we are committed to your privacy and confidentiality. All User Content used for AI training is anonymized and aggregated to ensure that your individual or business identity is protected and your specific jewelry designs are not exposed. This process helps us enhance the quality of our services for all users.
4. Our Intellectual Property

GemIQ IP: All rights, title, and interest in and to the Services themselves are and will remain the exclusive property of GemIQ and its licensors. This includes, but is not limited to:

License Granted to You: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the GemIQ IP strictly in accordance with our Terms of Service and for the intended purpose of our Services.

Restrictions: You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or attempt to extract the source code of our software or hardware. You may not use our branding or trademarks without our prior written consent.
5. Reporting Intellectual Property Infringement
We respect the intellectual property rights of others and expect our users to do the same.
If you believe that a user of GemIQ's Services has infringed upon your copyright or other intellectual property rights, please notify our Designated Agent with the following information:
1. A physical or electronic signature of the person authorized to act on behalf of the owner of the IP right.
2. A description of the copyrighted work or other intellectual property that you claim has been infringed.
3. A description of where the material you claim is infringing is located on our Service (e.g., a public URL, if applicable).
4. Your address, telephone number, and email address.
5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on their behalf.

Upon receipt of a valid notice, we will take whatever action we deem appropriate, including the removal of the challenged content and termination of the accounts of repeat infringers in accordance with applicable laws..
6. Policy Updates
We may revise this Intellectual Property Policy from time to time. The most current version will always be posted on our website. If a revision, in our sole discretion, is material, we will notify you via email to the address associated with your account or by posting a notice on our website.
